The Control of Liquidators by Guernsey Courts and the New Insolvency Rules

The workshop will cover the relatively recent case of Canargo, in which Lieutenant Bailiff Marshall set out the powers of the Guernsey Court to bless applications by a liquidator approving a particular course of conduct. The workshop will also cover the new Insolvency rules that are coming into effect after May 2021 and in particular, the rules on disclaimer and holding meetings.

ALEX HORSBRUGH-PORTER

Alex is part of Ogier’s multi-disciplinary Restructuring & Corporate Recovery team and Trust Advisory Group. Alex specialises in contentious insolvency procedures as well as shareholder applications and has experience in member and creditor schemes of arrangement. Alex has more than 20 years of experience in general commercial disputes involving financial services businesses and Guernsey trusts, as well as regulatory disputes, and he was previously a director of a local firm of insolvency practitioners. He has appeared in Courts in the Cayman Islands and Guernsey since 2004.

HEIDI SANDY
Senior Associate, Ogier

Heidi is an advocate and senior associate in Ogier’s Dispute Resolution team in Guernsey, specialising in trust and commercial disputes. She also has a wide range of experience in advising clients in response to Tax Information Exchange Agreement (TIEA) requests, emanating from various jurisdictions including India, Australia, Canada, Switzerland and Russia. In particular, she acted for the taxpayer in the first Guernsey challenge to the Royal Court, by way of judicial review proceedings, to a TIEA notice.
